These Terms of Service ("Terms") govern your access to and use of the KeyMax Property Management website and mobile application (the "Service") operated by Iconoclast Holdings LLC d/b/a KeyMax Property Management ("KeyMax PM," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
To use certain features of the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
You agree to use the Service only for its intended purpose of property management activities, including viewing lease information, making rent payments, submitting maintenance requests, and communicating with property management. You may not use the Service to transmit harmful, fraudulent, or unlawful content, or to interfere with the operation of the Service.
Rent payments processed through the Service are handled by third-party payment processors (Square). Payment processing is subject to the terms and conditions of the applicable payment provider. KeyMax PM is not responsible for errors, delays, or failures caused by payment processors. All payments are subject to your lease agreement.
The Service allows tenants to submit maintenance requests electronically. Submission of a request does not guarantee a specific response time. Emergency maintenance issues (fire, flooding, active water leaks, or safety hazards) should be reported directly to the property manager by phone.
By using the electronic signature feature of the Service, you agree that your electronic signature is legally binding and has the same force and effect as a handwritten signature, in accordance with the Electronic Signatures in Global and National Commerce (E-SIGN) Act and the Uniform Electronic Transactions Act (UETA).
The Service and its original content, features, and functionality are owned by Iconoclast Holdings LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any portion of the Service without our express written consent.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, KeyMax PM and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, regardless of the theory of liability.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
